EpsilonCode Terms of Service

Last updated: 1 October 2026

These Terms govern the use of the EpsilonCode service (the Service) available at epsiloncode.eu and dashboard.epsiloncode.eu, through the API and the EpsilonCLI application. By purchasing or using the Service you accept these Terms in full.

1. Definitions

  • Provider: the entity operating the Service, details in the Privacy policy.
  • User: a natural person aged 15 or older, or an entity with legal capacity, using the Service.
  • Plan: paid, prepaid access to the Service for a fixed period, with a unit limit and a defined set of models.
  • Pass: a paid time-limited add-on to a Plan, as described in the pricing.
  • Unit: the measure of Plan usage. A Normal request uses 1 unit, an Ultra request uses the number of units shown in the dashboard.
  • Vendor: a third-party AI model provider (e.g. Anthropic, OpenAI, Google) to which the Service relays requests.

2. Nature of the Service

The Service provides technical intermediation in accessing AI models offered by Vendors. The Provider does not create the models and is not responsible for the content of generated responses.

The Service is digital content not supplied on a tangible medium. Access is activated immediately after the payment is confirmed.

3. Purchases and payments

Plans and Passes are purchased exclusively in the dashboard at dashboard.epsiloncode.eu after logging in with Discord. Membership of the Provider's Discord server is required.

Prices are in Polish zloty and include VAT where applicable. Payments are processed by an external payment operator; the Provider does not store card data.

Plans do not renew automatically. Extension requires a new purchase. Renewing the same Plan keeps the usage of the current period; changing Plan starts a new period.

4. No refunds and right of withdrawal

All purchases are final. The Provider does not accept returns and does not refund, in whole or in part, purchased Plans or Passes.

Under Article 38(1)(13) of the Polish Consumer Rights Act of 30 May 2014 (implementing Directive 2011/83/EU, Art. 16(m)), the right to withdraw from a distance contract does not apply to contracts for the supply of digital content not supplied on a tangible medium if performance has begun with the consumer's prior express consent and acknowledgement that they thereby lose the right of withdrawal.

By placing an order the User expressly requests immediate performance of the Service and acknowledges that upon activation of access the right of withdrawal is lost.

No refund is granted in particular for: unused units, partial use of a Plan, change of mind, purchasing the wrong Plan, incompatibility with the User's software, account suspension for breach of these Terms, or changes to the model list or pricing after purchase.

This does not exclude consumer rights under mandatory law, including rights relating to non-conformity of digital content with the contract. Complaints are handled as described in section 10.

5. Availability and compensation

In case of total unavailability lasting more than 24 hours the administrator MAY, at their sole discretion, extend the User's Plan by one day for each commenced 24 hours of such unavailability. This is a right, not an obligation of the Provider. No claim for a refund or any other form of compensation arises.

The Service is provided as is. The Provider does not guarantee uninterrupted availability of the API, the dashboard or any particular model. Availability depends in particular on Vendors, over whom the Provider has no control.

Unavailability of individual models, reduced response success, latency, maintenance windows announced in the dashboard or on Discord, and limits resulting from the Plan do not constitute non-performance and do not entitle the User to compensation.

Total unavailability means exclusively a state in which, for an uninterrupted period of at least 24 hours, no function of the Service can be used, i.e. no model available in the User's Plan works. If even one model works during that time, total unavailability does not occur.

  • A request for extension must be submitted via a ticket on discord.gg/epsiloncode during the unavailability or within 48 hours after it ends.
  • The administrator's decision is final and not subject to appeal.

6. Changes to pricing, Plans and models

Pricing, Plan scope, unit limits, Ultra request weights and the list of available models may be changed at any time, without prior notice, including from one day to the next.

A price change does not affect the price of an already paid Plan period. The new price applies to the next purchase.

Models may be added, withdrawn, replaced or moved to another Plan due to Vendor decisions, costs or technical reasons. Withdrawal of a model during a paid period does not entitle the User to a refund or compensation; the User keeps access to the remaining models of their Plan.

The current pricing and model catalog are always visible in the dashboard at dashboard.epsiloncode.eu, which takes precedence over information on epsiloncode.eu.

7. Acceptable use

The following is prohibited in particular:

  • using the Service for unlawful purposes, creating malware, phishing, fraud, infringing third-party rights,
  • generating sexual, pornographic, violent, hateful content or content exploiting minors,
  • sharing the API key with third parties, reselling access without the Provider's written consent, creating multiple accounts to circumvent limits,
  • scraping, automated mass requests overloading the infrastructure, exploiting system bugs to obtain undue benefits,
  • acting to the detriment of the Provider, its infrastructure, reputation or other Users.

8. Suspension and bans

The Provider may suspend API access for a fixed period or until further notice, ban the account, revoke API keys, remove the User from the Discord server and block the IP address upon finding a breach of these Terms, suspected abuse or a threat to the Service.

A ban for breach of these Terms does not entitle the User to a refund for unused time or units. The administrator's decision is final.

9. Liability

To the fullest extent permitted by law the Provider is not liable for indirect damages, lost profits, loss of data or the content of model responses. The User is responsible for verifying results and for how they are used.

The Provider's total liability towards a non-consumer User is limited to the amount paid for the Service in the month preceding the event. Towards consumers liability is limited to the extent permitted by mandatory law.

10. Complaints

Complaints should be submitted via a ticket on discord.gg/epsiloncode or to [email protected], stating the Discord name, purchase date and a description of the problem. Complaints are handled within 14 days.

Consumers may use out-of-court dispute resolution, including the EU ODR platform at ec.europa.eu/consumers/odr.

11. Changes to the Terms

The Provider may change these Terms at any time. The amended Terms apply from publication at epsiloncode.eu/terms. Purchases made before the change are governed by the Terms in force at the time of purchase, except for sections 5 and 6, which by nature concern the current state of the Service.

12. Final provisions

These Terms are governed by Polish law. Disputes with consumers are resolved by the court competent under general rules; disputes with other Users by the court competent for the Provider's seat. Contact: [email protected], discord.gg/epsiloncode.
